Our policies and practices have been designed to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and corresponding provincial privacy acts.

Motion LP (“Motion”, “we”, “us”, or “our”) respects your privacy and is committed to protecting your personal information. “Personal information” means information about an individual who can be identified. We will also call this “your information”. This Privacy Policy (the “Policy”) outlines the personal information we collect, what we do with it, and why.

This Policy does not cover anonymous, de-identified, or business contact information.

You agree to this Policy when you:

  • Request or receive our services;

  • Apply for a job with us; or
  • Contact us or otherwise interact with us, whether online, by phone, or in person.

This Policy is also incorporated into and subject to our Terms of Service, which is available at https://motioncares.ca/terms-of-service/ (the “Terms”).

Your consent

As part of using our products or services or interacting with us, we may collect and process some details about you. When we do so, we will collect, use, or share your personal information with your consent for the purposes we’ve informed you of, or as may be otherwise permitted or required by law. Your consent can be express or implied. In some situations, we may get consent directly from you (including as described in this Policy). In other situations, we may rely on the consent you provided to someone else, such as an authorized representative or care provider.

You can withhold or withdraw your consent for us to collect, use, or share your personal information, as long as there are no legal or contractual requirements for us to process your information. Depending on the circumstances, however, withdrawal of your consent may impact our ability to serve you, or in the case of administering benefits, it may prevent us from processing your claims. Collecting and using your information

When and how we collect your information

We collect your personal information when you interact with us. This includes when you:

  • Apply for or receive a product or service; 
  • Take part in a virtual or in-person appointment or assessment;
  • Visit our Website or one of our locations;
  • Sign up for special offers or complete a survey; and
  • Communicate with us, including by phone, email, video call, messaging, or social media.

Usually the personal information we collect is the information that you provide us directly. However, we sometimes collect your information indirectly from other sources. These sources include:

  • Someone we believe you have authorized to act on your behalf, such as a power of attorney;
  • “Care providers,” such as occupational therapists, physiotherapists, long-term care homes, hospitals, and clinics;
  • Your insurer;
  • Online advertising partners; and
  • Government bodies or publicly available sources, if it’s relevant to providing our products and services or operating our business. 

Note that by providing us with personal information about others, you are representing that you have their consent or another legal basis to do so.

What information we collect and why

What information we collect depends a lot on what products or services you request, and what information you choose to provide us. The most common types of personal information we collect, and the main ways we use that information are:

  • Contact information, such as your name, address, email, phone number, or social media account name. We use this information to communicate with you about any inquiry or request, or to provide you with information about our products and services.
  • Information related to your home, which is information that a Motion representative may capture when you request products or services that require a Motion representative to visit or virtually view your home. During consultations, installations, or repairs, a Motion representative may capture or request images of your home and take other notes to determine which products and services are right for you, to confirm the installation or repair of our products, or to document potential concerns.
  • Payment and billing information, which can include your payment and billing information, your insurance information and, if appropriate, information from your health card and other public health billing information. We use this information to process payments and bill the appropriate parties.
  • Information about funding program eligibility, which includes information about your needs described above, your income, your medical condition (if appropriate), and whether you identify as an Indigenous person. Providing us with this information is voluntary. If you choose to provide us with this information, we can use and share this information with funding partners, such as governments and charities, to determine if you are eligible to access a funding program that will help you afford our products and services.
  • Online usage information, such as information about how you use our Website including the device you are using and how you came to our Website. When you visit our Website, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. For more information, see “Cookies” below.

We may also use your information listed above to:

  • Promote Motion and our products and services;
  • Improve our products, services, Website, and business;
  • Create statistical and aggregated reports using predictive models, rules, and insights (often your information will be anonymized or aggregated in a way that does not identify you beforehand);
  • Manage our day-to-day organizational and operational needs;
  • Protect the rights, property, and safety of Motion, our employees, and other stakeholders;
  • Prevent, detect, or investigate security concerns and illegal activity including fraud;
  • Comply with applicable laws, regulations, or industry requirements; and
  • For any other reason authorized by you or law.

Job applicants

If you submit a job application to us, we will use the information relating to that application (such as your employment history) to assess your suitability for any of our job postings. We may also collect information from third parties about you, such as the references you list or if we conduct a background check, for the same purpose.

Sharing your information

We may share your information for four main reasons: (a) operating our business; (b) working with care providers and other partners; (c) for legal reasons; and (d) if it’s relevant to buying or selling a company.

(a) Operating our business

We may share your information with other organizations (called “service providers”) that assist us in operating our business or providing our products and services. When we share information with service providers, we require them to commit to protecting your personal information in line with our own standards, and limit use and disclosure of the information for the specific purposes for which we supplied it.

(b) Working with care providers and other partners

We may share your information with care providers if doing so is reasonably required as part of the products and services we are providing. For example, if you live in a long-term care home, we may provide our products and services to you in coordination with them.

We may also share your information to assist you in accessing funding programs offered by governments, charities, and other organizations. Similarly, we may share your information with insurers, care providers, funding partners, and other organizations if it is relevant to providing our products and services and billing for them.

(c) Legal reasons

In rare circumstances, we may share your information about you if we reasonably believe that it is needed to:

  • Respond to authorized information requests from governmental authorities;
  • Comply with any valid legal process or applicable law, rule, or regulation;
  • To collect a debt, or to investigate, manage, or settle any actual or potential loss if there is a breach of agreement or contravention of the law;
  • Protect the rights, property, and safety of Motion, our employees, or others; or
  • Detect and resolve any fraud or security concerns.

(d) Buying or selling a company

We may share personal information with business partners where it is relevant to a potential or actual business transaction, such as the sale of Motion to another company, as part of a corporate re-organization, or to pursue a partnership or investment opportunity.

International transfer of your information

Your personal information may be transmitted, stored, or processed in countries other than your home country, in which case the information is governed by the laws of those countries and may be subject to law enforcement access.

Cookies

Cookies are small text files that are stored on the browser of your computer that assigns an anonymous identifier to your browser and provide information to the cookie sender. Cookies may be placed on your computer by us when you use our Website or other digital offerings. In addition, we may use third party cookies that track how you use our Website or other online resources in order to target advertisements to you on other websites. Google Analytics

We use Google Analytics to better understand your use of our Website. Google Analytics collects information on user behaviour on our Website, which includes how many times a user visits our Website, what pages they visit, and where they were referred from. Advertising identifiers for mobile devices (such as Android and iOS Advertising Identifiers) are also collected. Google uses this data to prepare reports on its activities and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network.

Facebook Pixel

We use Facebook Pixel to better understand your use of our Website. Facebook Pixel collects information on user behaviour on our Website, which includes how many times a user visits our Website, what pages they visit, and where they were referred from. Facebook uses the data collected through pixels to track and examine the use of the Website, to prepare reports on its activities, and share them with other Facebook services. Advertising identifiers for mobile devices (such as Android and iOS Advertising Identifiers) are also collected. Facebook may provide us with information associated with your Facebook account, such as your likes, location, and age. Facebook may use the data collected on the websites to contextualize and personalize the ads on its own advertising network.

Security

The security of your personal information is important to us. We protect your information by limiting access to it and by implementing reasonable physical, organizational, and technological safeguards as appropriate. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk.

Retention

We aim to keep your personal information only as long as necessary to provide you with the products and services you request or for other legitimate purposes such as complying with our legal obligations, improving our business, resolving disputes, or enforcing our agreements.

Accessing and correcting your information

We make reasonable efforts to keep your information accurate and up to date. To access or correct your personal information, submit a written request that identifies yourself, the information you want to review, and how we can contact you (see ‘Contact us’ below for how to contact us).

For access requests, we will inform you of the existence, use, and disclosure of the personal information that we maintain about you. We may not be able to provide you with all the information you request, depending on the circumstances, and there may be a charge for copies of your personal information.

If a change or correction is required, let us know right away. We’ll make any appropriate updates needed.

We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We update our Privacy Policy when needed to meet legislative changes, provide greater transparency, respond to changes in our products or services, or address changes in our data processing activities or policies.  

When we make material changes to this Policy, we will notify you as appropriate under the circumstances and post the most current version on the Website. Please make sure you read any such notice carefully. The most current version of this Policy will govern our use of your personal information.
